These Terms and Conditions govern your use of enaargy.in and purchases from Shivan Global, operating under the brand ENAARGY (“ENAARGY”, “we”, “us” or “our”). By using this website or placing an order, you agree to these terms, together with our Privacy Policy, Shipping Policy and Cancellation and Refund Policy.
Website use
You may use this website only for lawful personal or business purposes. You must not interfere with the website, attempt unauthorised access, introduce harmful code, misuse product information or use the website in a way that violates applicable law or the rights of others.
Product information
We make reasonable efforts to present product descriptions, specifications, colours, images, availability and prices accurately. Minor variations may occur because of display settings, manufacturing updates or product improvements. For project, dealer, OEM or bulk orders, the specifications and commercial terms confirmed in the applicable quotation or invoice will prevail.
Prices and taxes
Prices are displayed in Indian Rupees unless stated otherwise. Applicable taxes, delivery charges or other fees will be shown at checkout or communicated in a quotation. We may correct genuine pricing or listing errors and may cancel an affected order with a full refund of the amount received.
Orders and acceptance
Submitting an order is an offer to purchase. An automated acknowledgement does not necessarily mean that we have accepted the order. Acceptance occurs when we confirm or dispatch the order. We may decline or cancel an order because of stock issues, pricing errors, payment concerns, delivery limitations, suspected misuse or other reasonable operational reasons. If we cancel after receiving payment, the eligible amount will be refunded to the original payment method.
Payments
Payments may be processed by third-party payment providers, including Razorpay, and are also subject to the payment provider’s terms and checks. You must provide accurate billing and contact information and use a payment method you are authorised to use. ENAARGY is not responsible for delays caused solely by banks, card networks, UPI systems or payment-provider outages, but we will reasonably assist with payment-status enquiries.
Shipping and delivery
Shipping is governed by our Shipping Policy. Delivery dates are estimates unless expressly confirmed in writing. Risk of loss or damage passes as provided by applicable law and the agreed delivery terms.
Cancellations, returns and refunds
Cancellations, returns and refunds are governed by our Cancellation and Refund Policy. Customised, project-specific, bulk or special-order goods may have separate conditions communicated before order confirmation.
Warranty and support
Product warranties, where applicable, are limited to the period and conditions stated on the product page, packaging, invoice or warranty document. Warranty coverage generally does not include misuse, incorrect installation, unauthorised repair, external electrical conditions, normal wear, accidental damage or use contrary to instructions. Proof of purchase may be required.
Intellectual property
The ENAARGY name, logos, website design, product content, images, graphics and other materials are owned by or licensed to Shivan Global and are protected by applicable intellectual-property laws. They may not be copied, republished or commercially used without written permission, except as permitted by law.
Third-party services and links
The website may use or link to third-party services. We do not control their availability, content or separate terms. Use of a third-party service is subject to that provider’s policies.
Limitation of liability
To the maximum extent permitted by law, ENAARGY will not be liable for indirect, incidental, special or consequential loss arising from use of the website or products. Nothing in these terms excludes consumer rights or liability that cannot legally be excluded. Our total liability for an order will not exceed the amount paid for the affected product, except where applicable law requires otherwise.
Governing law
These terms are governed by the laws of India. Courts with jurisdiction over the relevant place of business of Shivan Global will have jurisdiction, subject to any mandatory consumer forum or statutory remedy available under applicable law.
Changes to these terms
We may update these terms from time to time. The version posted on this page will apply from its stated update date. Orders already accepted will remain subject to the terms applicable when they were accepted unless a change is required by law.
